"Services": Refers to the buying, selling, consignment, and sourcing of luxury watches.
3. ELIGIBILITY
You must be at least 18 years old to use our services. By using our website, you represent and warrant that you meet this age requirement.
4. ACCOUNT REGISTRATION
To use certain features of our website, you may need to register for an account. You agree to provide accurate and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. BUYING WATCHES
5.1 Product Descriptions
We strive to provide accurate descriptions of the watches we sell. However, we do not warrant that the descriptions are accurate, complete, reliable, current, or error-free.
5.2 Pricing
All prices are subject to change without notice. Prices do not include applicable taxes or shipping and handling charges, which will be added to your total invoice amount.
5.3 Order Acceptance
We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in the description or price of the product, or errors in your order.
5.4 Authentication Guarantee
Every timepiece we sell is meticulously inspected and authenticated by our in-house, professionally trained watchmaker. We stand behind our expertise with a 100% money-back guarantee on authenticity. If a watch purchased from us is determined to be inauthentic by a qualified third-party expert, we will provide a full refund of the purchase price upon return of the watch.
6. SELLING AND TRADING WATCHES
6.1 Evaluation
Watches submitted for sale or trade will be evaluated by our experts. We reserve the right to refuse any watch for any reason.
6.2 Offers
Offers made for your watch are valid for a limited time as specified in the offer. If you accept our offer, you agree to transfer ownership of the watch to us.
6.3 Payment
Payment for watches sold to us will be made via the method agreed upon during the transaction process. Accepted payment methods include Stripe, Zelle, wire transfer, and Bitcoin/cryptocurrency.
7. CONSIGNMENT SERVICES
7.1 Consignment Agreement
We offer a professional consignment service for clients looking to sell their fine timepieces. Consignment agreements are for a term of 60 to 90 days.
7.2 Security and Insurance
Your watch is fully insured and stored in our secure vault for the duration of the consignment agreement. We assume full responsibility for the merchandise while on consignment, bearing all risks associated with potential hazards. Ownership of the merchandise remains exclusively with the consignor until full payment is received from a buyer.
7.3 Marketing
We handle professional photography, listing, and marketing to our global network of collectors and buyers to achieve the best possible price.
7.4 Commission Structure
Our fee structure is a transparent percentage of the final sale price:
• 15% commission on watches sold for under $10,000
• 10% commission on watches sold for $10,000 or more
7.5 Payment to Consignor
Payouts are processed within 7 business days after (i) we receive full, settled payment from the buyer and (ii) the expiration of the 14-day return period has expired.
7.6 Consignor Warranties
The consignor certifies that they hold legal title to the merchandise and have the authority to transfer it to us. The consignor warrants that the consigned merchandise is genuine, authentic, and in good, saleable condition, and indemnifies us against any damages, losses, or costs resulting from a breach of this warranty, whether intentional or unintentional. This indemnification shall survive the termination of the consignment agreement.
7.7 Modifications
No alterations, modifications, polishing, or buffing of the merchandise will be undertaken without the consignor's written consent or until the item is sold and the agreed consignment price is received by us. Any changes to the consignment price must be mutually agreed upon in writing by both the consignor and us.
7.8 Return of Unsold Merchandise
If the item is not sold at the agreed consignment price within the consignment period, we will return the item to the consignor, upon the consignor's request, at our expense. The consignor must complete a Consignment Release Form before we will release any consigned merchandise back to the consignor.
8. SOURCING SERVICES
We offer private sourcing services to locate specific watches for clients. Sourcing requests are handled on a best-effort basis. We reserve the right to decline any sourcing request. There is no fee for sourcing services unless you choose to purchase a watch we have sourced for you.
9. RETURNS AND REFUNDS
9.1 Return Policy
We offer a 14-day return period, beginning the day the watch is delivered. To be eligible for a full refund, the item must be returned in the exact same, unworn condition as it was sold, including all original boxes, papers, and accessories.
9.2 Refund Process
Refunds are issued promptly after the item has been received and passed our quality control inspection. Shipping and handling charges are non-refundable unless the return is due to our error.
9.3 Non-Returnable Items
Custom orders, special items, or watches that show signs of wear or damage after delivery may not be eligible for return.
10. SHIPPING AND DELIVERY
10.1 Domestic Shipping
All domestic shipments are sent via FedEx Overnight, fully insured.
10.2 International Shipping
International shipments are sent via FedEx International, depending on location. International sales are limited and subject to our discretion.
10.3 Hand Delivery
Hand delivery is available for select local clients by arrangement.
10.4 Risk of Loss
All items purchased from us are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
11. PAYMENT METHODS
We accept the following payment methods:
• Stripe (credit card processing)
• Zelle
• Wire transfer
• Bitcoin and other cryptocurrencies
Payment must be received in full before merchandise is shipped. We reserve the right to refuse any form of payment or require alternative payment methods at our discretion.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
(i) your use or inability to use our services;
(ii) any unauthorized access to or use of our servers and/or any personal information stored therein;
(iii) any interruption or cessation of transmission to or from our services;
(iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party;
(v) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the services;
(vi) the defamatory, offensive, or illegal conduct of any third party; or
(vii) any damage to, or loss of, watches during shipping, storage, or handling (subject to our insurance coverage).
13. INDEPENDENT DEALER DISCLAIMER
Royalty Timepieces is an independent watch dealer and is not sponsored by, associated with, or affiliated with Rolex S.A., Patek Philippe S.A., Audemars Piguet Holding S.A., or any other watch brand manufacturer. All trademarks, logos, and brand names are the property of their respective owners. Any reference to brand names or trademarks is for descriptive purposes only and does not imply endorsement by or affiliation with the respective manufacturers.
14. INTELLECTUAL PROPERTY
All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of Royalty Timepieces or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, or create derivative works from any content on our website without our express written permission.
15. GOVERNING LAW
